This privacy policy applies to the What's in here? app (hereby referred to as "Application") for mobile devices that was created by Oliver Holl (hereby referred to as "Service Provider," "we," "us," or "our") as a Free service. This service is intended for use "AS IS".

This page is used to inform visitors regarding our policies with the collection, use, and disclosure of Information if anyone decides to use our Service.

By using the Application, you agree to the collection and use of information in accordance with this policy.

Information Collection and Use

For a better experience while using our Application, we may collect certain information. The type of information collected is described below:

1. Information You Provide via Camera:

  • Camera Access: To use the core functionality of the Application (scanning food labels), we require access to your device's camera. Permission for camera access will be requested.
  • Image Data: When you scan a food label, the Application captures an image.
  • Image Data Processing (Google Gemini API): This image data (or text extracted from it) is securely transmitted directly from the Application to Google's Gemini API servers. This transmission is necessary for the AI-powered analysis of the food label's ingredients, processing level, and allergens.
  • Google's Handling: According to Google's policies for its AI services, the data sent is used to provide the analysis result back to the Application. We, the Service Provider (Oliver Holl), do not store this image data or the raw text extracted by Google on our own servers after the analysis is complete. We only display the results within the Application. Your interaction with the Gemini API via our Application is subject to Google's relevant terms and data usage policies (see Third-Party Services section below). We do not use this image data for any purpose other than providing the core scanning feature via Google's service.
  • Scan Results: The results of the scan (information about ingredients, processing, allergens) are displayed within the Application.

2. Automatically Collected Information:

The Application may collect certain limited information automatically, including, but not limited to:

  • Device manufacturer and model
  • The operating system version used on your mobile device
  • Basic Application usage information (e.g., features used, session duration) solely for the purpose of maintaining and improving the Application's stability and core functionality.

This automatically collected information is processed minimally and is not used to personally identify you.

The Application does not gather precise real-time information about the location of your mobile device.

3. Personally Identifiable Information (PII):

The Application does not require you to provide personally identifiable information such as your name, email address, or phone number to use its core scanning features. If you choose to contact us for support via email (at [email protected]), we will use your email address solely to respond to your inquiry.

Third-Party Services

The Application utilizes third-party services that are essential for its operation or may collect information. These services have their own Privacy Policies regarding how they handle data. We encourage you to review their policies.

We may share aggregated, anonymized usage data (as described in section 2) with external services strictly to aid us in improving the Application's stability and core functionality.

We may disclose Automatically Collected Information or information provided via user contact:

  • as required by law, such as to comply with a subpoena, or similar legal process;
  • when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • with our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement (primarily Google for the Gemini API processing).

Opt-Out Rights

You can stop all collection of information by the Application easily by uninstalling it. You may use the standard uninstall processes available as part of your mobile device or via the mobile application marketplace or network.

Data Retention Policy

  • Scan Data (Images/Text): As described above, scan data sent to Google Gemini API is processed by Google according to their policies and is not retained by us (Oliver Holl).
  • Automatically Collected Data: We retain minimal, anonymized or aggregated automatically collected usage data only for as long as necessary to ensure the stability and improvement of the Application.
  • User Contact Data: If you contact us via email, we retain that correspondence as necessary to address your query and for a reasonable time thereafter for record-keeping.

If you'd like us to delete any potential User Provided Data associated with you (primarily support correspondence, as the app doesn't store PII otherwise), please contact us at [email protected] and we will respond in a reasonable time.

Children's Privacy

The Application is not intended for use by children under the age of 13. We do not knowingly solicit data from or market to children under the age of 13.

The Application does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from children under 13 years of age. In the case we discover that a child under 13 has provided personal information, we will immediately delete this from our records. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us at [email protected] so that we will be able to take necessary actions.

Security

We are concerned about safeguarding the confidentiality of your information. While we do not store sensitive scan data, we implement reasonable measures to protect any minimal data processed or retained (like contact correspondence). Please be aware that data transmission to third-party services like Google Gemini API relies on their security measures and transmission over the internet carries inherent risks. No security system can prevent all potential security breaches.

Changes

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy on the web page where it is hosted. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

Your Consent

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. "Processing," means using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information. Your information, particularly the image data sent for analysis, will be processed by Google's infrastructure (used for the Gemini API) which may operate servers globally, including in the United States or other countries outside of Switzerland. Usage of the Application constitutes your consent to this transfer and processing under the applicable privacy standards of Google and as outlined herein.
